Acceptance of These Terms
These Terms and Conditions ("Terms") govern the websites, software, MTAP platform, TAP by MBS NFC services, digital profile tools, customer dashboards, account verification systems, subscription services, support services, and related products provided by Marketing Big Solutions LLC ("Company", "we", "us", or "our"). By accessing, purchasing, activating, registering, or using our services, you agree to these Terms.
Services Covered
Our services may include website services, marketing services, web design, digital business profiles, NFC-enabled cards, tags, bracelets, stickers, MTAP profiles, Experience pages, NFC access, subscription plans, customer dashboards, device activation, business networking tools, lead capture tools, and related support.
Accounts, Verification, and Security
You agree to provide accurate contact, billing, business, and account information. Some services require email verification, phone verification, one-time passcodes, SMS verification, NFC activation, or other security checks. You are responsible for protecting your login credentials, verification codes, assigned devices, NFC cards, profiles, and account access.
MTAP NFC Devices and Digital Profiles
MTAP cards, tags, bracelets, stickers, and digital devices may require activation before use. A device may be linked to a digital profile, Experience page, business page, or another approved destination. Unauthorized activation, transfer, cloning, resale, tampering, or misuse is prohibited.
Plans, Subscriptions, Upgrades, and Add-Ons
MTAP may offer plans such as One, Basic, Pro, Business, promotional plans, gift plans, internal/directive plans, and custom enterprise plans. Plan features, device limits, editing limits, templates, Experience features, galleries, add-ons, and support levels may vary. We may update plans, pricing, features, limits, or add-on rules at any time, subject to applicable law and customer-facing notices.
Payments, Failed Payments, and Chargebacks
Paid services may be processed through third-party payment providers such as Stripe or other approved processors. You authorize applicable charges for products, services, subscriptions, setup services, add-ons, shipping, custom work, or upgrades. Failed payments, disputes, fraud flags, chargebacks, or unpaid invoices may result in account suspension, feature limitation, delayed fulfillment, or termination.
Refunds and Cancellations
Refunds are governed by our Refund Policy and any written purchase terms presented at checkout. Digital services, activated profiles, custom work, setup fees, shipped devices, customized NFC products, activated devices, and completed services may be non-refundable. Subscription cancellation may stop future renewals but does not automatically refund prior paid periods unless required by law or approved in writing.
SMS and Electronic Communications
By providing your mobile number, you may consent to receive transactional SMS messages related to account verification, OTP codes, device activation, security alerts, service notifications, and support. Marketing SMS requires separate consent where required. Message and data rates may apply. Reply STOP to opt out where supported and HELP for help. Opting out of transactional verification messages may prevent access to some account or activation features.
Acceptable Use
You may not use our services for unlawful, fraudulent, abusive, misleading, harmful, spam-related, infringing, or unauthorized activity. You may not interfere with the platform, attempt unauthorized access, misuse verification codes, impersonate others, upload malicious files, or damage the reputation, security, customers, or operations of Marketing Big Solutions LLC or MTAP.
Customer Content
You are responsible for any business information, profile content, images, links, logos, services, descriptions, social media links, files, or other content you upload or publish. You represent that you have the right to use that content and that it does not violate law, privacy rights, intellectual property rights, or third-party rights. We may remove content that we believe violates these Terms or creates risk.
Public Profile Information
Information placed on a public MTAP profile, digital business card, Experience page, or public landing page may be viewable by anyone with access to the link, NFC device, shared profile. Do not publish private information that you do not want publicly accessible.
Intellectual Property
All software, source code, dashboards, platform logic, workflows, templates, designs, graphics, copy, branding, logos, documentation, manuals, systems, and business materials owned or controlled by Marketing Big Solutions LLC remain our property. MTAP, TAP by MBS, and related trade names, platform features, and brand assets may not be copied, modified, resold, reverse-engineered, or used without written authorization.
Third-Party Services
Our services may rely on third-party providers for hosting, domains, payment processing, SMS delivery, email delivery, analytics, maps, cloud storage, carriers, internet access, and other infrastructure. We are not responsible for outages, delays, filtering, carrier failures, provider errors, or other issues caused by third parties outside our reasonable control.
No Guarantee of Results
Marketing Big Solutions LLC and MTAP do not guarantee that any customer will receive sales, leads, followers, appointments, revenue, business growth, customer conversions, search rankings, or any specific commercial result from using our services.
Suspension and Termination
We may suspend, restrict, deactivate, or terminate access if we believe an account, device, profile, seller, representative, or customer violates these Terms, creates risk, misuses services, fails to pay, disputes charges improperly, engages in fraud, or violates applicable law.
Disclaimer and Limitation of Liability
Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim warranties of uninterrupted availability, error-free operation, device compatibility, carrier delivery, or specific results. Our liability is limited to the amount paid for the service giving rise to the claim, unless a greater limitation is prohibited by law.
Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any dispute shall be handled in a court or forum located in Texas unless a separate written agreement requires another process.
Changes to These Terms
We may update these Terms from time to time. Updates will be posted on this page with a revised date. Continued use of our services after updates means you accept the updated Terms.
